These Terms of Use (hereinafter "Terms" or "ToU") govern the relationship between Musette, a simplified joint-stock company (SASU) registered with the Trade and Companies Register of Créteil under number 999 438 096, having its registered office at 58, Avenue Paul Déroulède - 94300 Vincennes, France (hereinafter the "Company" or "We"), and any individual or legal entity (hereinafter the "User" or "You") accessing the website, mobile application, or any online service operated by Musette (hereinafter the "Service").

These Terms define the conditions for accessing and using the Service. They constitute a binding legal agreement between Musette and the User. By accessing or using the Service, You acknowledge that You have read, understood, and agree to be bound by these Terms.

1. Scope and Definitions

• Scope: These Terms apply to any access to or use of the Service, whether You are a visitor or a registered member.
• Service: Includes access to music games and quizzes, account creation, social features (Battles), and all digital content provided by Musette.
• User: Any person or entity accessing the Service.
• Content: All information, text, graphics, videos, audio, music works, databases, and software available on the Service.
• Virtual Items: Digital items usable within the Service, including but not limited to virtual currency ("Coins"), energy ("Tickets"), power-ups, and badges.

2. Acceptance and Modification

• Acceptance: By using the Service, You agree to these Terms. If You do not agree, You must not use the Service.
• Updates: Musette reserves the right to modify these Terms at any time. The updated version will be published on the Service and becomes effective immediately. Your continued use of the Service after any changes constitutes Your acceptance of the new Terms.

3. Description of Services

Musette provides a digital entertainment platform focused on music:

• Music Games & Quizzes: Interactive games where users identify songs based on visuals or audio snippets.
• Battles & Community: Features allowing multiplayer gameplay with friends or other users.
• Subscriptions & Advertising:
  • The Service may display mandatory interstitial advertisements.
  • VIP Subscription: The VIP subscription removes mandatory interstitial ads. However, VIP Users retain the option to voluntarily view "Rewarded Ads" to earn specific in-game benefits (e.g., extra tickets). VIP status does not prevent access to these optional rewards.

4. Registration and Account Security

• Registration: You agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your credentials.
• Eligibility: You must be at least 18 years old or have the permission of a legal guardian to create an account.
• Security: Musette shall not be liable for any unauthorized access to your account resulting from your failure to keep your login information secure.

5. User Conduct, Cheating, and Game Integrity

You agree to use the Service lawfully and fairly. The following are strictly prohibited:

• Illegal Content: Distributing content that is threatening, defamatory, obscene, discriminatory, or unlawful.
• Battles & Public Spaces: You agree not to use usernames, "Room" names, or avatars that are offensive, hateful, sexually explicit, or politically charged during multiplayer games (Battles). Musette reserves the right to moderate or ban any account violating these community standards.
• Cheating & Data Integrity: To ensure fair play in Leaderboards and gameplay, You are strictly forbidden from:
  • Using bots, automation scripts, or third-party software to play or collect rewards on your behalf.
  • Exploiting technical glitches or bugs to alter scores, experience points (XP), or currency gains.
  • Artificially manipulating matchmaking or progression mechanics.
• Sanctions: In the event of suspected cheating or unfair behavior (detected via data analysis), Musette reserves the right to reset scores, disqualify You from Leaderboard rewards, or permanently suspend your account without refund.

6. Limited License to Use

Musette grants You a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service. This license is strictly limited to private, non-commercial entertainment use. Any public performance (e.g., in bars, events, broadcast) is prohibited without prior written consent from Musette.

7. Intellectual Property

• Ownership: All elements of the Service (interface, graphics, logos, code, game concepts) are the exclusive property of Musette.
• Music Content: Musical excerpts and visuals used in quizzes are exploited by Musette in compliance with intellectual property rights, either through licenses, statutory exceptions, or partnerships. You are prohibited from extracting, recording, or redistributing them outside the Service.
• Trademarks: Any use of Musette's trademarks or logos without authorization is prohibited.

8. Third-Party Services and Ads

• Social Login: You may log in via third-party services (Facebook, Google, Apple). Use of these services is subject to their own Terms and Privacy Policies.
• Advertising: The Service displays ads provided by third-party networks. Musette is not responsible for the products or services promoted by these third parties.

9. User Generated Content (UGC)

By submitting content to the Service (profile picture, username, messages), You grant Musette a worldwide, royalty-free, transferable license to use such content for the operation and promotion of the Service. You warrant that your content does not infringe upon the rights of any third party.

10. Disclaimer of Warranties and Limitation of Liability

• "AS IS" Basis: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. Musette does not guarantee that the Service will be error-free or uninterrupted.
• Limitation of Liability: To the fullest extent permitted by law, Musette shall not be liable for any indirect, incidental, or consequential damages. Musette's total cumulative liability shall not exceed the amount paid by You to Musette during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold Musette harmless from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Public Performance and Events

Organizing game sessions in public venues (bars, companies, associations) constitutes a public performance. You acknowledge that Musette does not provide public performance licenses for the music used. It is the sole responsibility of the event organizer to obtain necessary licenses from the relevant Performance Rights Organizations (e.g., ASCAP, BMI, SESAC, SACEM, etc.).

13. Privacy and Data Protection

The collection and processing of personal data are governed by Musette's Privacy Policy. In compliance with the GDPR and applicable laws, You have the right to access, rectify, and delete your data.

14. Financial Terms and Virtual Items

• Purchases: Paid services (Coin Packs, VIP Subscriptions) are charged at the rates in effect at the time of order.
• Subscriptions: Subscriptions may auto-renew. You can manage or cancel subscriptions via your app store settings (Apple App Store / Google Play Store).
• Legal Status of Virtual Items (Coins, Tickets, Badges):
  • Virtual Items constitute a limited, personal, revocable, non-exclusive, non-transferable license to use digital content within the Service.
  • No Ownership: You acknowledge that Virtual Items are not your personal property, have no monetary value in the real world, and cannot be exchanged for real money, goods, or services.
  • No Refunds: Except as required by law, Virtual Items are non-refundable and non-exchangeable, even if your account is closed or terminated.
• Waiver of Withdrawal Right: By purchasing digital content (Coins, Tickets), You expressly consent to the immediate performance of the contract and acknowledge that You lose your right of withdrawal/cancellation once the content is delivered.

15. Termination

Musette may suspend or terminate your account at any time, without notice or liability, for any breach of these Terms, specifically including cheating (Section 5), toxic behavior, or payment fraud. Termination results in the immediate forfeiture of all Virtual Items associated with the account.

16. Force Majeure

Neither party shall be liable for any failure to perform its obligations due to events beyond its reasonable control (force majeure), including internet failures, natural disasters, or war.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of France. In the event of a dispute, and following an attempt at amicable resolution, exclusive jurisdiction is granted to the courts located within the jurisdiction of Musette's registered office, unless mandatory consumer protection laws in your country of residence require otherwise.
